Welcome to MONTELUCI EYEWEAR. These Terms of Service ("Terms") govern your access to and use of our website and your purchases from our store (the "Services"), operated by MONTELUCI EYEWEAR ("MONTELUCI", "we", "us", or "our").
By accessing or using the Services or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Services. These Terms do not affect your statutory rights as a consumer.
1. Eligibility
By using the Services, you confirm that you are at least 18 years old, or that you are using the Services with the consent of a parent or guardian, and that you are able to enter into a legally binding agreement.
2. Products and Availability
We make every effort to display our products and their colors as accurately as possible. However, we cannot guarantee that your device displays colors accurately, and actual products may vary slightly in appearance.
All products are subject to availability. We reserve the right to limit quantities, discontinue any product, or refuse any order at our discretion.
3. Pricing and Errors
All prices are listed in euros (EUR) and include Dutch VAT (BTW) where applicable, unless stated otherwise.
We take care to ensure prices and product information are correct. However, errors may occur. We are not bound by obvious typographical, pricing, or descriptive errors. If we discover an error in the price of an item you have ordered, we will contact you and give you the option to confirm your order at the correct price or cancel it. If we cannot reach you, we may treat the order as cancelled.
We reserve the right to change prices at any time. The price that applies to your order is the price displayed at the time you place it.
4. Orders and Acceptance
Your order is an offer to purchase. A contract between you and us is formed only once we send you an order confirmation. We reserve the right to refuse or cancel any order, including in cases of suspected fraud, payment issues, or stock shortages. If we cancel an order you have already paid for, we will issue a full refund.
5. Payment
Payment must be completed at the time of ordering through the payment methods offered at checkout. Payments are processed securely by our third-party payment providers. We do not store your full payment card details.
6. Shipping and Delivery
We aim to deliver within the timeframe indicated at checkout and on our website. Delivery times are estimates and are not guaranteed. We are not liable for delays caused by circumstances beyond our reasonable control, such as carrier delays or customs processing. Risk of loss passes to you once the order has been delivered to the address you provided.
7. Returns and Refunds
You may return your order in accordance with our Return & Refund Policy, which forms part of these Terms. Your statutory right of withdrawal of 14 days applies as described there.
8. Intellectual Property
All content on the Services — including the MONTELUCI name, logo, branding, text, images, and design — is owned by us or our licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or use any of this content without our prior written permission.
9. Acceptable Use
You agree not to use the Services for any unlawful purpose, to interfere with their operation or security, to attempt unauthorized access, or to use any automated system to access or scrape the Services without our permission.
10. Limitation of Liability
To the fullest extent permitted by law, MONTELUCI shall not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the Services or any products purchased through them.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for any matter that cannot be excluded or limited under applicable consumer law. Your statutory rights as a consumer remain unaffected.
Where our liability cannot be excluded but can be limited, our total liability to you shall not exceed the amount you paid for the relevant order.
11. Privacy
Your use of the Services is also governed by our Privacy Policy, which explains how we collect and process your personal information.
12. Changes to These Terms
We may update these Terms from time to time. The version that applies to your order is the one in effect at the time you place it. We will post the updated Terms here and revise the "Last updated" date above.
13. Governing Law
These Terms are governed by the laws of the Netherlands. Any disputes will be subject to the jurisdiction of the competent Dutch courts, without prejudice to any mandatory consumer protection rights you may have in your country of residence.
